The Special Battery Park City Zoning District is one of many special zoning districts in New York City. Special Districts have additional zoning requirements otherwise not stipulated in the Zoning Resolution.

 

Special Battery Park City Zoning

New York City has many special zoning districts. These districts have additional rules and regulations beyond the typical zoning codes. Battery Park City has its own Special district known as the Special Battery Park City District or BPC. Below we will outline some of the special regulations withing the BPC. One unique aspect of the BPC is that with the Batter Park City District an entire block is to be treated as a single zoning lot for the purpose of zoning.

The Battery Park City Zoning Special District is broken into a few sections:

  • Zone A South Residential Neighborhood
  • Zone A North Residential Neighborhood
  • Zone B
  • Zone C

 

Battery Park City Special Zoning District Regulations

  • Prohibited Uses

 

Prohibited Uses in the BPC

Within Battery Park City there are certain uses that are not allowed even if the underlying Zoning District normally would permit them. A few examples of prohibited uses are Wholesalers are not allowed and Hotels have certain restrictions. There are others but I am not going to list them all here.

Battery Park City Zone A

Zone A is meant primarily for residential buildings retail and services. Hotels with some restrictions are allowed. Zone A has 6 subzones:

  • A-1
  • A-2
  • A-3
  • A-4
  • A-5
  • A-6

Additional Use Restrictions and Limitations

There are additional commercial use restrictions in Zone A with regards to the type of commercial use. There are also limits on how many square feet can be allocated to certain uses. The highest restrictions are along the Esplanade.

Building Bulk Regulations

Zoning Floor Area Ratio is modified for developments in the Battery Park City Special District.

There are specific requirements for the building front wall that must be adhered to including restrictions in recesses in front walls.

Some lots will require a mandatory Arcade.

There are additional height limitations on buildings.

Zone B

Zone B has requirements for Pedestrian Bridges.

Zone C

Use In Zone C

Uses in Zone C of the Special Battery Park City Zoning District are modified for C6-6 Zoning and its residential equivalent R10.

Building Bulk Regulations in Zone C of the BPC

There are limitations on building floor area. Zoning bonuses are not allowed in Zone C.

There are specific requirements for the building front wall that must be adhered to including restrictions in recesses in front walls.

Zone C has building height limitations.
